In order to correct or prevent misconceptions some preliminary observation should be made: first, that reprieve, the postponement of execution of the judgment, is not a suspension of the judgment itself, the distinction being that the postponement merely puts off or defers the execution of the judgment to a certain day, while suspension of the judgment is for an indefinite time (Carnal vs. People, 1 N. R., 262); second, that postponement of execution of the judgment does not in any way affect the executory nature thereof, and it will be carried out on the day to which it has been set forward.
