Conditions subsequent refers to conditions which occur after the formation of a contract. This phrase refers to an occurrence which terminates the duty of a party to perform or do his/her part. Although there is a binding contract, one party has an escape clause provided that the contract terminates should certain conditions arise, ie if a company goes bankrupt. In a deed to real property, a condition subsequent refers to an event which terminates a person’s interest in the property (ie if a person gets divorced, they no longer have certain rights or interests in real property).
