Article 301. Recovery of Property from Another's Unlawful Possession

The owner has the right to recover its property from another's unlawful possession. (The Civil Code of the Russian Federation by Peter B Maggs)

The remedy sought in the present proceedings is a recovery order in terms of section 266 of the 2002 Act. The effect of such an order is to remove property from its existing owner and transfer it to the trustee for civil recovery.
