To promote settlements and avoid litigation, Congress included a claim presentation procedure in both OPA and CERCLA. This procedure requires that trustees present their claims to the potentially responsible party and gives the defendant 90 days for payment (60 days in case of CERCLA). The purpose of the claim presentation procedure is to enable the trustees and the defendant to negotiate a settlement.
