Retrial refers to the conducting of a new trial in its entirety in the same court after it was already tried and a decision or verdict was reached. It is granted upon a motion by the losing party in the original trial. Granting ofa retrail may be based on a procedural error, bias or newly discovered evidence, or after mistrial or reversed by an appeals court. (USLegal)
In September, a mistrial was declared after jurors were unable to reach a unanimous decision on the degree of guilt. (BBC)
A mistrial occurs when a jury is unable to reach a verdict and there must be a new trial with a new jury; or there is a serious procedural error or misconduct that would result in an unfair trial, and the judge adjourns the case without a decision on the merits and awards a new trial. A mistrial is a trial that is not completed. Instead, it is halted and declared invalid, usually before a verdict is delivered. (Fully Informed Jury Association)
