The actio negatoria permits the owner to resist or deny the existence of an alleged servitude or other right for the defendant to cause physical disturbance of the land.[101] It can also be used when movable property has been alienated without the owner's consent, and delivered notwithstanding, pending the institution of the rei vindicatio; and in situations where a person has interfered with the owner's enjoyment, to compel that person to restore the status quo ante.
