A person is guilty of solicitation to commit a crime if, with the purpose of promoting or facilitating its commission, he commands, encourages or requests another person to engage in specific conduct which would constitute such crime or an attempt to commit such crime or which would establish his complicity in its commission or attempted commission. (USLegal)
Therefore, a clear articulation and communication of what has to be done and delivered in response to a problem through a precise description of activities, outputs, and deliverables, is a prerequisite for potentials service providers to respond realistically and competitively to our requirements. This articulation and communication is known as Terms of Reference (TOR), or a Statement of Work (SOW). Adequate and clear TOR is imperative for an understanding of the assignment, which minimizes any risk of ambiguities during the preparation of solicitation documents, negotiations and execution of services.
The use of the terms TOR and SOW essentially refer to the same thing and serve the same purpose. For professional services contracts, it is more appropriate to use the term TOR as a common practice.
Terms of Reference (TOR) is a detailed description of services that a contractor is required to perform in execution of a contract. (United Nations Development Programme)
Nevada law prohibits solicitation and prostitution unless it takes place in a licensed house of prostitution. (The Nevada Independent)
For example, if a boy walks up to his schoolmate on the street and asks him to shoplift a toy for him, this is solicitation, even if the schoolmate never acknowledges the boy's request, enters the store, or completes the crime. In fact, should the solicited individual, such as the schoolmate, actually complete the crime, the defendant may be liable not only for solicitation, but also for aiding and abetting the crime as an accessory before the fact.
